When Fence Permits Are Required:
All new fence construction require permits. A fence permit is also required when replacing a fence or changing the type of fence (wood to ornamental, etc.), or extending the fence.
A building permit is required on retaining walls over 4 feet (4’) in height.
Fences in Residential Areas
Fences cannot impede the drainage within easements. Fences may be painted or stained with natural wood colors.
Fences being placed on the side or rear yards of properties that are not adjacent to a street, park or trail cannot exceed eight feet (8’) in height above the grade of the property.
Fences being placed on the side or rear yards for properties that are adjacent to a street, park or trail cannot exceed six feet (6’) in height above the grade of the property. Posts and structural components must be placed on the interior of the lot.
Fences in the front yard cannot exceed thirty-six inches (36″) in height and shall be at least 50% open. Chain link fencing is not permitted.
Lots within the SF-LD zoning district may have split rail, ornamental metal, tubular steel or similar open fencing material in the front yard. The fencing cannot exceed five feet (5’) in height.
No barbed wire or electrical or chain link fencing is allowed except for farming or ranching purposes on undeveloped land of two (2) or more acres in size.
Wood fencing (new or replacement) adjacent to a thoroughfare shall be constructed of cedar material, metal posts with cedar top and bottom caps. The fence must be stained with Ready Seal or an equivalent wood sealant material.
Swimming pools are required to be completely surrounded by a fence with a self-closing / self-latching gate. Any openings in the fence cannot be wider than 4 inches or allow a 4-inch sphere to be passed through the opening.
Corner Lot Fences
Corner or double frontage lot fencing must comply with the final plat building setback line. The distance may be reduced to eight feet (8’) from the property line if the fence is constructed of ornamental metal, tubular steel or similar material with live screening.
If a corner lot is adjacent to a subdivision-screening wall, a fence may be placed outside the required setback line in order to connect to the screening wall.
If a corner lot is adjacent to an existing fence where the fence has been legally permitted to be five feet (5’) from the property line, the new fence may be constructed with the same type of fence material in order to be flush with the existing fence.
